What to Know about Harassment

Defining Harassment:

When a landlord uses aggressive methods, coercion, fraud, or intimidation to get the tenant to move, disrupting the tenant’s right to the quiet enjoyment of their rental property.

Why might you be harassed?

Landlords of rent controlled areas, such as Beverly Hills, Los Angeles, Santa Monica, and West Hollywood, want long-term tenants to move out in order to raise the rent to match the market. Evictions are long and costly, so landlords sometimes resort to harassing and threatening tenants to move out.

Are you protected?

CALIFORNIA CIVIL CODE § 1940.2 protects you if your landlord has...

  • Engaged in forceful, threatening, or menacing conduct;

  • Disclosed information regarding the perceived immigration or citizenship status of the tenant or someone close to them;

  • Threatened to call immigration authorities to force a tenant out;

  • Interfered with the tenant's right to quiet enjoyment of their property;

  • Entered the rental unit without the tenant's consent in substantial violation of the law; and

  • Taken, deprived, or removed the tenant's property from their home without permission.
